The decision date for your application is currently scheduled for September 9, 2003. <br />Therefore, I would appreciate a response from you on or before September 2, 2003. (Your response <br />should include two (2) copies). This proposed amendment application appears to result in the following changes from the original <br />Regular 112 Application approved by the Division on September 11, 2002: 1) increase in permitted <br />acreage from 105.41 acres to 128.26 acres, 2) increase in total mined acreage from 84 acres to 91 acres, 3) <br />mining in 5 phases rather than 13 phases, 4) creation of 5 groundwater fed lakes rather than 1 groundwater <br />fed lake, 5) creation of a total of 91 acres of water surface during final reclamation rather than 84 acmes. <br />Please clarify any other significant changes in the mining and reclamation of the River Valley Resource <br />site, and how the mine plan, plant site, and reclamation plan will be improved as a result of this <br />amendment application. <br />2. The original application for a Regular 112 Permit included a number of commitments as specified in the <br />application and adequacy review responses from Applegate Group, Inc. dated November 20, 2001 and <br />December 4, 2001. Please verify if you wish to remove any of the commitments made at that time and <br />why such commitment should be removed. As an example, Lafarge West, Inc. has been approved for a <br />maximum disturbance of 40 acres at any one time with a reclamation cost of $270,200. Please respond. <br />3. There appears to be at least 700 linear feet of the Phase 2 azea within 300 feet of the Yampa River. <br />Please indicate the elevation of the proposed amendment azea in relation to the elevation of the top of bank <br />for the north bank of the Yampa River, provide an assessment of the potential for flooding and pit capture <br />by the river during a high flow event, and provide any mitigation measures to be employed at the River <br />Office of Office of Colorado <br />Mined Land Reclamation Arrive and InaRive Mines Geologscal5sscvey <br />
