Who is the owner of the ditch and does the operator have permission to relocated it? <br />If the operator does not own the ditch, the operator needs to provide proof that he has <br />permission to relocate it. <br />The irrigation ditch in question is owned by Eagle County. Eagle County has given Lafarge <br />permission to relocate the ditch as detailed in Paragraph 10 of the Fifth Amendment to Sand and <br />Gravel Mining Lease dated March 21, 2006. A copy of the lease is included as Appendix B. <br />ITEM 4 -Numerous manmade structures are located either inside the proposed mining area or <br />within two hundred feet of the proposed mining area. These structures include, but are not <br />limited to, the baseball fields and associated fences, Fairgrounds Road and associated utilities, <br />the buildings in the northeast corner of AREA E, and the existing/relocated irrigation ditch. In <br />accordance with Rule 6.4.19, please provide information su)~cient to demonstrate that the <br />stability of any structures located within two hundred feet of the operation or affected Zand will <br />not be adversely affected. <br />The DMG raised the question of several buildings located in the northeast portion of AREA E. <br />These structures will be removed in accordance with Pazagraph 14 of the lease included in <br />Appendix B. A question as to whether the stability of any structtues within 200 feet of mining <br />will be affected was also raised. These structures include the baseball fields and associated <br />fences, Fairgrounds Road and associated utilities, and the relocated irrigation ditch, all of which <br />are owned by Eagle County. Lafazge has obtained a notarized agreement with Eagle County <br />regarding damage to man-made structures within 200 feet of our mining pursuant to Rule 6.4.19 <br />(a). Furthermore, it is Lafazge's position that mining activities will not adversely affect the <br />structures in question given the present conditions. This position is based on historic evidence of <br />the site's stability throughout the life of the mine. Previous phases of mining have encountered <br />similaz structures with similaz set backs from mining activities with no adverse affects. <br />Specifically, the existing run of the ditch along the north side of AREA D was mined vertically <br />within approximately the same distance from the ditch proposed in AREA E and then backfilled <br />to attain the 3:1 slope specified in the reclamation plan with no adverse effects on stability. The <br />mine plan for AREA E indicates the closest mining will come to a major structure (Fairgrounds <br />Road) is approximately 70 feet which will maintain a 2:1 ratio of distance to the structure verses <br />depth of the pit. Such a ratio is typical of aggregate mining in Western Colorado. During mining <br />and reclamation activities, Lafazge will visually monitor for signs of instability and take <br />corrective actions as needed. The proposed extent of mining activities can be seen on Exhibit F <br />which is included in Appendix A. A copy of the agreement between Lafazge and Eagle County <br />regazding permanent man-made structures is included as Appendix C. <br />
