It is obvious that the pipeline, where it crosses the extraction area, will have to be avoided, protected or moved several years from now when mining approaches it. Provide a notarized agreement between the present owner of the pipeline and Holcim agreeing that Holcim will compensate the owner for any damage to the pipeline. Provide a plan for protection, or removal or relocation of the pipeline. The plan must be reviewed and agreed to in writing by the owner on his letterhead and a copy provided to the Division. If such an agreement can not be reached, the following stipulation will be added to the approval of this proposed amendment. Stipulation No. 1-Holcim will not affect land within 200 feet of the natural gas pipelinE located in cuts 13, 14, 16 and 18 without first having an agreement with the owner of that pipeline for protection ,removal or relocation of the pipeline. A copy of the agreement, on the owner's letterhead, will be filed with the Division and become a part of the permit. Division approval must be obtained prior to affecting land within 200 feet of the pipeline. Response: Holcim has been in contact with the natural gas company (Colorado Interstate Gas), and will be setting meetings to discuss and negotiate the relocation of the pipeline to an area where it will not be impacted by the mining activities.
