Division of Minerals and Geology <br />March 31, 2003 <br />Page 12 of 17 <br />formation bedding planes/fractures will no longer do so, since the disturbed profile will disrupt <br />the present subsurface flow system. To the extent that the current lower Bear Creek stream flow <br />is the result of recharge due to irrigation of agricultural lands north of Highway 50, the disruption <br />of the limestone bedding planes/fractures that currently feed lower Bear Creek will significantly <br />reduce the already low base flow in this portion of Bear Creek. The result will be a net increase <br />of deeper infiltration to and saturation of the lower portions of any remaining unmined limestone <br />and/or the underlying Codell sandstone in the lower Bear Creek area. Eventually, equilibrium <br />will be reached, with a net outflow into the Arkansas River alluvium and/or into the underlying <br />sandstone aquifer. <br />Item No. 30 <br />DMG: The Office of the State Engineer, Division of Water Resources provided the following <br />comment regarding the diversion of Bear Creek. "The application has listed that up to 0.25 cfs <br />of water will be diverted from Bear Creek for the creation of a wetlands. Diversion of water in <br />over appropriated areas, such as this, requires a plan for augmentation of substitute water supply <br />plan. " Please contact the Division of Water Resources, Division 2 Office and inguire about the <br />need for an augmentation plan or substitute water supply plan. If either is needed, provide that <br />information in this exhibit as well as Exhibit M. <br />Response: <br />It is Holcim's understanding that, with the abandonment of the initial plan to create new wetlands <br />on the north side of the river by diversion of water out of Bear Creek, this is no longer an issue. <br />Item No. 31 <br />DMG. Your application includes plans to divert Bear Creek. Our engineer has conducted an <br />initial review of those plans and needs more information to complete his review. Please address <br />his questions and requests in the following lint. <br />Response; <br />As DMG is aware, Holcim is proposing a new alignment for the permanent relocation of the <br />reach of Bear Creek that crosses the mine area. Please see Figures C-5 through C-9, and the <br />attached Preliminary Bear Creek Relocation Hydraulic Modeling Study for details. Responses to <br />the specific issues raised by DMG areas indicated below. <br />a. The operator should submit a compaction plan of the fill sections and berm segments <br />of the re-alignment. Also, lift thickness information should be included. <br />Response: <br />As indicated by the attached figures, the new design has no fill sections. <br />b.
