a) The damage waiver with Yampa Valley Electric Association is still in effect <br />and will be legally binding for the duration of the mining and reclamation <br />operation at River Valley Resource. <br />b) The fences are generally more than 25 feet from the mining crest. The <br />exception to this is the fence adjacent to the relocated Suttle Ditch, which will be <br />15 or more feet away. Based on the Greystone study of the stability of the Suttle <br />Ditch dated January 14, 2003, Lafarge does not believe that there is a significant <br />risk to these stmctwes at 25 or more feet from the neazest pit crest. However, as <br />with any other structure, should any action of Lafarge affect the fences, Lafarge <br />will, at our own expense, correct the situation. <br />c) It is Lafarge's belief that there are only two roads on or neaz the property: the <br />mine entrance to the planned operation and the access road to the More Family <br />residence on the eastern boarder. As shown on EXHIBIT C, the eastern terminus <br />of the main access road is 200 or more feet from the neazest pit crest. After this <br />point, all other roads aze internal roads for mining the individual phases. <br />Reclamation will reclaim these roads to the terminus of the main access road post <br />mining. <br />With regard to the access road to the More Family residence on the eastern <br />boarder, the road is in excess of 50 feet from the mining crest at all times. The <br />closest approach to the permit boundary is at the northeastern corner of the <br />current permit at approximately 60 feet. Therefore, according to the Greystone <br />study, this structure should be stable. As with the fences and the utility line, <br />should any actions of Lafarge cause damage to this stmcture, Lafarge, at its own <br />expense, will correct the situation. <br />4) In response to your question concerning the other man-made structures located within <br />200 feet of the pit crest, please find attached a letter concerning the stability of any man- <br />made structure. As with the other geotechnical exhibits, Greystone Environmental <br />Consultants has also prepared this analysis. <br />Lafarge trusts that our responses have addressed all of the concerns expressed in your August 21, <br />2003 letter.
