(Lafarge) has prepared the following responses to your letter of August 21, <br />2003. This response will address each point in the same order as your letter. Tn addition, Lafarge <br />has also prepared a response to your question concerning the stability analysis of any man-made <br />structure within 200 feet of the mining crest. Our responses are as follows: <br />1) Lafarge West, Inc. will supply the DMG either a signed, notarized agreement with the <br />owners of the Suttle Ditch or a court decree allowing the relocation of the ditch prior to <br />moving the Suttle Ditch or mining closer than 40 feet as recommended by Greystone <br />Environmental Consultants (Greystone) in the attachment to this letter. As stated in <br />previous correspondence, Lafarge is pleased to accept this as a condition of our permit <br />amendment. <br />2) It is Lafarge's intention to obtain the agreement and/or court decree for the relocation <br />of the Suttle Ditch as soon as possible after completing this Permit Amendment. It is <br />Lafarge's preference that the relocated ditch be constructed and tested prior to mining <br />closer than 40 feet of the existing structure (as determined by the Greystone Stability <br />Study). However, according to our mine plan we will not be closer than 40 feet of the <br />Suttle Ditch for the first three years or so. For this reason, Lafarge will initiate mining as <br />soon as all of the necessary permits are in place whether the agreements for the relocation <br />of the Suttle Ditch are in place or not. However, Lafarge will not mine closer than 40 <br />feet to the Suttle Ditch until all of the requisite agreements are in place. <br />3) With regard to the man-made structures on or adjacent to the site, it is Lafarge's <br />opinion that we have met the requirements of the regulations for mining closer than 200 <br />feet by commissioning the attached stability study. It is Lafarge's opinion that the <br />stability analysis completed by Greystone Environmental Consultants provides the <br />necessary data to support this opinion.
