You are aware that the requirement to obtain an approved amendment resulted from the <br />January 20, 2004 Board Order. So, the amendment application must be approved by June 19, <br />2004 (approval includes Division acceptance of an adequate bond) or the $50,000 suspended <br />civil penalty may be reactivated. <br />File a copy of this adequacy letter and your response with the County Clerk and Recorder (do <br />not have the documents recorded) and provide the Division with an affidavit or receipt <br />demonstrating that the revision was filed with the Clerk and Recorder. <br />Prior to final Division consideration of the application, you need to submit proof of <br />publication and proof that all other notices were sent out as required. <br />Please submit two copies of your response (includes the maps). <br />If you have any questions, please contact me at 303-866-4060. <br />Sincerely, <br />James Dillie <br />Environmental Protection Specialist <br />cc: Harry Posey (e-mail) <br />
