6.4.19 EXHIBIT S -Permanent Man-made Structures <br />13. The applicant has provided a letter dated January 24, 2003 from Rodney A. Harr of <br />Landmazk Engineering Ltd. referencing a structure agreement with the City of Loveland Water <br />and Power Department. Please indicate the status of this agreement and provide such agreement, <br />if available. Also, please indicate whether such agreement includes any possible damages to the <br />overhead electric lines within 200 feet of the planned excavation. Please address. <br />14. The applicant has also provided a cross sectional diagram and commitment to maintaining a <br />25 foot setback from the City of Loveland sanitary sewer line. In the absence of the notazized <br />agreements as referenced in Item 13 above, the applicant can demonstrate compliance with Rule <br />6.4.19 by either a) providing a written commitment to maintaining a minimum setback distance <br />of at least twice (2x) the depth of excavation as measured from the toe of excavation to the edge <br />of any and all structures, and by marking the setback distance prior to excavation, orb) providing <br />a stability analysis that demonstrates that any such structure will not be damaged by activities <br />occurring at the mining operation. (Structures include sewer or utility lines, roads, buildings, <br />electric power switchyazds, and road rights of way). Please address. <br />15. Attached aze review comments from the U.S.Army Corps of Engineers and the Office of the <br />State Engineer. Please address. <br />Once again, I will look forwazd to your response on or before April 18, 2003 to allow adequate <br />time for review before the April 28, 2003 decision date. Rule 1.8.1 states that changes and <br />additions to the permit application must be filed with the Division and the County Clerk and <br />Recorder.
