The amendment application references lining of two (2) ponds during final <br />reclamation to provide approximately 42 surface acres of water storage. The total permitted <br />acreage, 195 acres, remains the same. The decision date for your application is scheduled for <br />April 28, 2003. Therefore, I would appreciate a response from you on or before April 18, 2003 . <br />(Your response should include two (2) copies). Please be advised that your conversion <br />application may be deemed inadequate and may be denied on Apri128, 2003 unless the following <br />adequacy review items aze addressed to the satisfaction of the Division. <br />6.4.3 EXHIBIT C -Pre-Mining and Mining Plan Man(s) of Affected Lands <br />1. The applicant mentions "the City of Loveland has a R.O.W. through the property which <br />contains Wilson Avenue. The County also has a R.O.W. through the property which contains <br />County Road 19E (Namaqua Avenue). The City of Loveland also has property in close <br />proximity that contain an electrical switch yard and a public golf course." Please clarify whether <br />any streets or their right of ways occur within 200 feet of any existing or planned excavation. <br />6.4.4 EXHIBIT D -Minin¢ Plan <br />2. The applicant mentions in the "Amendment Overview" that excavation in cells 6 & 7 is 90 to <br />95% complete, that the lining of these cells is 60 to 70% complete, and some reclamation has <br />been completed. Incompliance with Rule 6.4.4(d) please provide details of the average depth of <br />excavation, total number of linear feet of liner to be installed, number of lineaz feet of liner <br />
