Cattany <br />Grand junction, Colorad/o 81502 Acting Division Director <br />RE: Spring Creek Pit, Permit No. M-1994-097, Amendment No. 2 Second Adequacy Review `~ <br />Dear Mr. Johnson: <br />DMG has completed the preliminary adequacy review of your application far Amendment Nd. 2 (AM-02) to <br />Permit No. M-1994-097. The application cannot be approved until the following issues are adequately <br />addressed. Please submit a response to the following issues by 4:00 PM today. If you cannot respond <br />by 4:00 PM today please submit a written request for extension of the decision date. If your response, or an <br />extension request, are not received by 4:00 PM today this application may be denied. Because of the <br />amount of material required to be addressed so this application meets the requirements of the Mined Land <br />Reclamation Act and the Construction Materials Rules and Regulations, DMG suggests that any decision due <br />date extension request be for no less than 30 days. <br />The issues below are numbered as they were in the Preliminary Adequacy Review. <br />ADEQUACY ISSUES <br />1. Please submit proof that S and R Delta Partners LLLP received a copy of the public notice <br />specified in Rule 1.6.2(1)(e). The copy of notice to Qwest Communications indicates it was <br />received by Owest on March 21, 2003. Without a waiver of the 20 day comment period, by <br />Qwest, DMG cannot approve AM-02. The earliest date we could approve the application would <br />be April 10, 2003. <br />2. Response acceptable. <br />Exhibit C -Mine Plan Mao <br />3. Please ensure all adjacent landowner, easement holder and permanent man-made structure <br />owners are noted on this map. Features identified during the pre-operational inspection that are <br />still not shown on the application map include: <br />• The phone junction box located on the south side of LaSalle Road directly across from the <br />access road entrance; <br />• the fence that runs south from iYs connection with the east-west fence on the south side of <br />LaSalle Road, near power pole no. 1 (as noted on the latest map submittal); <br />• the overhead powerlines and possibly one power pole on each side of power pole no. 1, <br />along the south side of LaSalle Road; <br />• the buried power lines that connect to the power junction box located on the east side of <br />the new access road, near the north end. <br />
