<br />~~ <br />Division within five (5) working days and cooperate in any further investigations or permit <br />modifications that are determined to be necessary for the protection of ground water. <br />3. The Operator will provide the Division of Minerals and Geology with a proposal for points of <br />compliance and numeric protection levels for the dissolution surface monitoring of potentiometric <br />pressure and temperature once the dedicated probes aze installed and operational. The Operator will <br />also provide a proposal for a separate compliance protocol for the dissolution surface since <br />temperatures and pressures above the numeric protection limit are indicative of leakage from the <br />mining cavities and may require immediate corrective action. The numeric protection levels will be <br />based on the data collected over the thirteen-month ambient ground water study correlated with the <br />initial data generated by the dedicated probes. Based on [he initial probe data, the Division will <br />determine if the incorporation of dissolution surface numeric protection levels into the permit will <br />be an additional technical revision filing, or a component of technical revision TR-003. In either <br />case, the dissolution surface points of compliance, numeric protection levels, and compliance <br />protocols will be binding on the Operator and enforceable components of the reclamation permit. <br />4. The Operator will provide the Division with a copy of the United States Geologic Survey (USGS) <br />sampling and analysis audit report when it becomes available and cooperate on the incorporation of <br />any USGS recommendations into the sampling, analysis and compliance plan or plans approved in <br />the reclamation permit. <br />The Operator will provide additional information on ground water Flow direction in the vicinity of <br />the 0-5 year mining panel as determined to be necessary through consultation with the Division. <br />The Operator will further cooperate with the Division to include additional point of compliance <br />wells if it is determined to be necessary for downgradient monitoring of the mining panel. <br />-2- <br />
