Long <br />Drcision Ducaor <br />Item: Consideration of the application for technical revision TR-03 <br />Division of Minerals and Geology Specialist: Allen Sorenson <br />Summary: During the June 1999 meeting, the Board conditionally approved the application for <br />reclamation permit M-1999-002. The approved application included a 13 month ambient ground water <br />chazacterization plan designed to facilitate the development of permit conditions protective of ground <br />water. The Board ordered during the June 1999 hearing that the permit conditions protective of ground <br />water be incorporated through a technical revision process [ha[ would ensure the opportunity for <br />meaningful public participation. In accordance with the Board Order, the American Soda has provided <br />a technical revision application including proposed points of compliance and numeric protection levels <br />protective of ground water present in the strata overlying [he nahcolite solution mining interval. <br />Staff Recommendation: The Division of Minerals and Geology recommends approval of technical <br />revision TR-003 to Permit No. M-1999-002 with the following conditions: <br />Ground water in the vicinity of the Yankee Gulch Sodium Minerals Project is subject to regulation <br />through permits issued by the Colorado Mined Land Reclamation Board, the U.S. Bureau of Land <br />Management (BLM), and the U.S. Environmental Protection Agency (EPA). If BLM and/or EPA <br />requires permit conditions protective of ground water that potentially conflict with conditions <br />approved in the reclamation permit, the Operator will contact the Division of Minerals and Geology <br />(DMG) within a reasonable time and cooperate in revising the reclamation permit as necessary to <br />address any conflicting requirements. If BLM and/or EPA impose permit conditions protective of <br />ground water that differ from those in the re n etTrtit, but are not necessarily in conflict, the <br />Operator will contact the DMG within a reasonable time d cooperate in the determination as [o <br />whether or not revision of the reclamation permit is necessary. <br />2. The Operator will provide a full report of all ground water monitoring activities by creating a <br />separate section in the annual reclamation report required under section 34-32-116, C.R.S. If <br />evidence of non-compliance with permit conditions protective of ground water is found, the <br />Operator will follow the Division of Minerals and Geology "Ground Water Compliance Protocol" <br />(attached). If "early warning indicators" listed in attachment 1 to technical revision TR-003 aze <br />exceeded in wells that are not designated points of compliance, then the Operator will notify the <br />
