All overburden material will be stockpiled in the pit, subject to inundation in event of permit <br />default, therefore, as long as overburden remain in pit bottoms, there should be no additional <br />permit liability needed under warranty. There is a point where material may need to be <br />temporazily brought to upper perimeter areas to complete finished slopes. We therefore <br />recommend the Division provide for up to 25,000 cu. yds. of overburden above pit locations as a <br />precaution respective of this consideration. <br />For purposes of warranty determination, the calculations to add to the previous warranty <br />estimate are as follows: <br />25,000± cu.yds. overburden at top of slope <br />X $0.19±per Exhibit L -assumptions for similar handling <br />$ 4,750.00± increase to Exhibit L -Total <br />9. Maximum Disturbance -Exposed Highwall: VCI has indicated that the maximum number of <br />linear feet of exposed, advancing pit highwall throughout the remainder of the operation will be <br />8001inear feet, at an average height of 25 feet. Unless otherwise specified by VCI, the 800 linear <br />feet of exposed highwall will become an enforceable component of the mine and reclamation <br />plan. If a criteria other than 800 linear feet is preferred by VCI, please specifiy the maximum <br />number of linear feet of exposed highwall that will become an enforceable component of the <br />mine and reclamation plan. Please respond. <br />The length of this wall will be quadrupled to assure compliance over all locations within the <br />permit not otherwise provided for in this Amendment. The financial warranty determination is <br />therefore amended as follows: <br />From Page 9 Exhibit L -Reclamation Costs: Advancing Pit Wall (Note: assumes a vertical pit <br />wall, whereas most unfinished walls will be less than vertical and therefore the cost is greater <br />than real world conditions): <br />$ 1,759.26± <br />X 4 (3200 linear feet total) <br />$ 7,037.04± <br />- 1 759.26f <br />$ 5,277.78± increase to Exhibit L -Total <br />10. De-Watering & Dry Mining -Hydrologic Impacts: The CGRS Dewatering Evaluation Report <br />predicts hydrologic impacts based on 73 acres of operation dewatered and excavated to bedrock. <br />This evaluation indicates that the Carbaugh groundwater well to the south will be impacted but <br />not completed (sic) dried up, and that groudwater wells on the north side of the Cache LaPoudre <br />river (sic) will not be impacted as long as Yhere is water flowing in the river. Previously the <br />Division had requested that VCI provide an assessment of the hydrologic impact to be expected at <br />the time of maximum pit excavation due to their de-watering and dry mining activities.
