Candidly, I do not believe this <br />represents such a case. <br />(2) You also requested a copy of Appendix M to Permit No. M-88-112, the BMG <br />"Emergency Response Plan", referenced by BMRI in their "Surface Water and <br />Groundwater Containment Plan for Tailings Area", submitted on June 15, <br />1992 (copied to all the Parties by BMRI>, in response to the Division's <br />second directive within Abatement Requirement 1t6. I am enclosing a <br />copy. As discussed above, requests of this nature place a significant <br />additional burden on our limited manpower and fiscal resources. In the <br />future I will have to ask you and the other Parties to avail yourselves <br />of the public files provided for this purpose in our offices. <br />We have attempted, whenever practical, to remedy situations in which the <br />various Parties have neglected to copy all other Parties. I will continue to <br />attempt to do so when the potential seriousness and our resources waYrant. <br />However, every minute consumed in such activities is one less minute the <br />Division can dedicate t~ cur more important mandated tasks relating to review <br />of the technical issues. <br />I trust that you will bring future oversights to my attention. I also <br />hope that the Division can rely on your tolerance and cooperation. It is our <br />intention to strictly assure everyone's rights for permit review and public <br />comment.
