Lonq, <br />DrvieiOn Director <br />This letter will serve to acknowledge our telephone co~lversatipn of <br />June 15, 1992. Specifically, I would like to note two points you cb~lled to my <br />attention. <br />(1) Dr. James Stevens' implication, in his letter of June 15, 1992 to Andre <br />J. Douchane, that no comments had been received from the parti@s <br />regarding the technical adequacy of BMG's 7R-008 (Groundwater Monitoring <br />Plan). In fact, I had received three general letters of comment during <br />the prior several weeks, from Maria Mondragon Valdez, representing PAES <br />(dated June 11, 1992, received June 15 by FAX), Maclovio C. Martinez, <br />representing CCCD (dated June 12, 1992, received 12 by FAX), and Scott G. <br />Mefford, hydrogeological consultant to PAES (dated June 8, 1992, received <br />June 15, 1992). <br />Each of these letters contains an assortment of comments addressing <br />general concerns regarding Battle Mountain Resources' operation at the <br />San Luis project and the selection of technical revisions and reports <br />submitted during the past several months. One comment in Maria Valdez's <br />letter, comment #6, did specifically address a technical adequacy item <br />relating to TR-008. However, I was aware that Dr. Stevens' comment !fl in <br />his letter of June 15, 1992, addressed the identical concern. For this <br />reason, I did not forward the comment letter to Jim's attention. <br />Therefore, Jim share's no responsibility for the incorrect statement. <br />The frenetic pace of recent exchanges in regard to the Battle Mountain <br />Gold permit consideration has resulted in a significant increask in the <br />Mineral Program's work load. We will continue to assiduously fulfill the <br />Division's responsibilities. We will also strive to expedite the process <br />to efficiently use our limited manpower whenever possible. When, on <br />occasion, an incorrect statement or oversight occurs, I will isgue a <br />clarification if I believe the occurrence jeopardizes the public health <br />and safety or <br />
