The Division of Minerals and Geology (Division) is <br />required to make an approval or denial decision no later than May 12, 2005, therefore, your <br />response to the following adequacy review concerns should be submitted to the Division as soon <br />as possible. <br />1. As required by Rule 1.6.2 (1)(g), please submit the proof ofpublication of the public notice <br />circulated in the local newspaper and notice to all owners of record of surface lands, mineral <br />owners, easement holders, and owners of record of surface lands that are within 200 feet of <br />the boundary of the affected land. Proof of notice may be return receipts of a Certified <br />Mailing or by proof of personal service. <br />2. Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professional <br />engineer, or other qualified person. The maps submitted to the Division were not signed. <br />Please resubmit a signed copy of the maps. <br />Rule 6.4.5 Exhibit E-Reclamation Plan <br />3. On page 5 of Exhibit E, the operator states, "...although not part of this proposed reclamation <br />amendment, the lined depression could potentially be used by future landowners as a <br />stockpond." The way this sentence is worded implies that the lined stockpond is not a <br />component of this amendment application. This statement was also noted in the letter from <br />the Office of the State Engineer (OSE) attached to this, letter. Please clarify if the lined <br />stockpond is a component of the revised reclamation plan. <br />4. The compacted clay liner is discussed in the application, but it is uncleaz as to the source of <br />the clay to be used to construct the liner. The reclamation cost estimate iri Exhibit L infers <br />that 36,000 CY of material is necessary to construct the clay liner.
