Based on the foregoing findings of fact and conclusions of law, the Board orders that <br />Hall-Irwin Corporation's application to amend Permit No. M-1998-013 is hereby <br />approved as AM-01, with the following conditions: <br />A reportable spill is a spill of any toxic or hazardous substance (including spills of <br />petroleum products) within the mined land permit area reportable to any Division <br />of the Colorado Department of Public Health and the Environment, the National <br />Response Center, the Colorado Emergency Planning Commission, any local <br />Emergency Planning Commission, local Emergency Planning Committee, or the <br />State Oil Inspector. The Mine Operator shall notify the Division of Minerals and <br />Geology (DMG) of a reportable spill within the mined land permit area using the <br />same timeframe required by the permit, license, notice, statute, rule or regulation <br />governing the reporting of the spill to the other appropriate agency. Notice of a <br />reportable spill shall be FAXed to: Minerals Program Supervisor, Division of <br />Minerals and Geology, FAX (303) 832-8106. The FAX shall include acall-back <br />number of a responsible company official for DMG staff to use a contact. <br />2. The Applicant shall provide an updated proof of Legal Right of Entry, to the <br />satisfaction of the Division, prior to the Applicant implementing the modifications <br />requested in the Amendment Application. <br />3. If the Operator intends at some point to request the 20 percent bonding option for <br />slurry wall installation, the following minor changes must be incorporated into the <br />slurry wall specifications. (The numbering system is taken from the "Draft <br />Technical Specifications for the Construction of the Shores Resource Slurry <br />Wall," dated January 2003). <br />a. Item 1.01 of section 01010 of division 1 of the specifications should be <br />changed to include units (linear feet) for the "20,000 of slurry wall" to be <br />installed. <br />b. Item 1.02 of section 01300 of division 1 of the specifications should be <br />changed to include units (centimeters per second) for the maximum <br />permeability of the soil-bentonite backfill. <br />c. In Table 1 included with the specifications, change the specified value for <br />sand content in the slurry to state "sand content less than 20 percent by <br />volume." <br />4. Hall-Irwin Corporation shall submit a map to the Division that identifies the <br />buffer zone specified in the parties' surface use agreement for the Kerr-McGee oil <br />and gas well identified as KM BLCS-lA. <br />DATED this // day of `/"1'J ~~J , 2003. <br />
