A) Has Hall-Irwin identified all existing oil and gas wells for the area of <br />affected land and within 200 feet of all boundaries? <br />B) Has Hall-Irwin identified the total area to be involved in the proposed <br />mining operation, including the area to be mined and the rare of affected lands? <br />C) Has Hall-Irwin provided notarized agreements with Objectors or an <br />appropriate engineering evaluation that demonstrates the structures will not be <br />damaged by mining activities? <br />D) Is Hall-Irwin obligated to propose a buffer zone between proposed mining <br />operations and the Objectors' future oil and gas wells? <br />3. The Board appointed a prehearing conference officer who conducted a prehearing <br />conference on January 28, 2003. As a result of that conference, the officer prepared a <br />proposed prehearing order and offered it to the Board for its consideration at the <br />commencement of this proceeding. <br />4. The parties informed the Board that, just prior to the hearing, they have reached a <br />surface use agreement that resolves all issues. <br />5. The Division recommended approval of the application with three conditions. <br />6. The parties propose a fourth condition that would require the Applicant to commit to <br />a buffer zone between a future Kerr-McGee oil and gas well and the Applicant's <br />mining operations. The Applicant proposes to implement this commitment by <br />submitting a revised map that reflects the buffer zone. <br />7. The Board finds all conditions to be reasonable and acceptable and further finds that <br />all issues have been resolved by the parties' settlement. <br />ORDER <br />
