The <br />disturbed acreage associated with the surface facilities is less than the permitted acreage since the <br />actual volume of waste material generated during mining was less than anticipated. Not all of <br />the 13.75 acres listed in Exhibit A of the permit are delineated on the map Exhibit C, of the <br />permit. However, a survey of the actual disturbance in the surface facilities area shows that 8.55 <br />acres aze disturbed. The footprint of the disturbance is shown on the revised map, Exhibit C, <br />submitted with the recent request (July, 2004) for a Technical Revision to Permit No. M-1978- <br />116. <br />Statement: <br />All applicable portions of the Reclamation Plan requirements (Permit No. M-1979-116) have <br />been satisfied for the 5.0 acres described above. The rangeland aspect of the land still exists <br />since the 5.0 acres were never disturbed during mining operations of the SM-18 Mine. <br />Furthermore, future mining plans will not result in disturbance of the same 5.0 acres.
