Room 215 <br />Denver, CO 80203 / <br />Subject: Permit No. M-1978-116, SM-18 Mine // <br />Reclamation Responsibility Release / <br />Dear Mr. Mount: <br />Division al Minerals and GeoloBY <br />~~- ( ~ <br />This letter is a notice to DMG that Cotter Corporation is requesting a release of reclamation <br />responsibility for a portion of the affected acreage under Permit No. M-1978-116. The permit <br />covers the SM-18 Mine, located on the U.S. Department of Energy Lease Block No. AT(OS-0)- <br />ML-60.8-C-SM-18. <br />The DOE office that manages this lease is: <br />Department of Energy <br />2597 B-3/4 Road <br />Grand Junction, CO 81503 <br />Phone: 970-248-6000 <br />The permitted affected acreage of M-1978-116 is 14.9 acres. During past mining, Cotter's <br />surface disturbance consisted of only 8.71 acres, including 8.55 acres at the SM-18 Mine portal <br />area in SW'/< SW'/4 Section 22, T.48N, R.17W., NMPM, in Montrose County, Colorado; and <br />0.16 acres at a ventilation hole in NW'/4 NW'/o Section 27, T 48N, R.17W. Therefore, 6.19 acres <br />of the original permitted acreage has not been disturbed. <br />Cotter Corporation is requesting a release of reclamation responsibility of 5.0 acres of the <br />undisturbed 6.19 acres. <br />A breakdown of the 5 acres being requested for release is as follows: <br />When the original application for Permit No. M-1978-116 was submitted, Cotter could anticipate <br />the need for surface disturbance, but could not show the exact location of some of it on a map. <br />This was pazticulazly true of ventilation hole sites. Six ventilation holes sites were included in <br />the original permitted acreage totaling 1.15 acres. Only one site was ever constructed, consisting <br />of .16 acres, leaving 0.99 acres that were never disturbed. The other 4.01 acres of undisturbed <br />land requested for release is in the area of the surface facilities listed on the Permit Exhibif A in <br />Cotter Corporation -West Slope Operations Telephone (970) 864-7347 <br />P.O.
