<br /> <br />employ the approved ground water monitoring <br />network according to the approved monitoring <br />plan until it is demonstrated to the <br />Division's satisfaction during the final <br />reclamation phase of the tailings facility and <br />collection pond that water flow from th@ <br />tailings facility to the collection pond has <br />ceased to be measurable for a period of one <br />year, and that ground water below the tailings <br />facility .and collection pond is of such <br />quality that no remediation efforts are <br />required. The Division will consider that <br />ground water not requiring remediation is <br />water that meets the same Water Qualit~ <br />Control Commission standards or approve <br />permit conditions for the mine that must be <br />met at points of compliance established for <br />the tailings facility and collection pond. <br />Should the Division determine that evidence of <br />any significant contamination of ground water <br />from leaks or discharges from mine facilities <br />has been detected by monitoring or other means <br />prior to such demonstration, Battle Mountain <br />Resources will be responsible for instituting <br />and completing the remediation procedures <br />approved in the permit. <br />2. Battle Mountain Resources will, within 60 days <br />of the approval of TR-O8, install an <br />additional ground water monitoring well at a <br />location acceptable to the Division between <br />the collection pond and the toe of the <br />tailings dam. This well will be drilled, <br />logged, and completed in a manner acceptable <br />to the Division, and comparable to that <br />employed for Wells M-9 and M-12. Evidence <br />demonstrating the installation will be <br />provided to the Division within 30 days of the <br />completion of the well. This well will be <br />maintained and employed for ground water <br />monitoring of the Santa Fe Aquifer as approved. <br />in the permit for Wells M-9, M-12, and M-13. <br />3. Battle Mountain Resources will submit, within <br />60 days following approval of TR-O8, a <br />technical revision to the permit which, when <br />approved, will outline the manner in which <br />Battle Mountain Resources will demonstrate to <br />the Division's satisfaction the quality of <br />ground water beneath the tailings facility and <br />collection pond prior to any request by Battle <br />Mountain Resources for full release of <br />reclamation responsibility and bond. <br />
