Long <br />Division Director <br />Technical Revision 8 <br />The Division has received your letter dated August 27, 1993 in <br />which you have indicated the conditions to the apgrova~l of TR-08 <br />proposed by the Division are not entirely acceptable toy BMRI. The <br />Division is also committed to reaching an acceptable resolution to <br />the issues surrounding TR-OS but, unfortunately, does not share <br />your view that these conditions were not fully discus$ed and an <br />understanding reached between representatives of Battle Mountain <br />and the Division in the meeting on July 2, 1993. My notes indicate <br />Conditions 2 thru 4 were acceptable to BMRI's representatives at <br />that time. Nothing more than a revision of Condition 1 was <br />requested then by BMRI in order that there be some manner in which <br />the company could justify the termination of the monitoring network <br />before a minimum of 15 years of operation. As a result of that <br />understanding, the Division only proposed, in its letter of July <br />12, 1993, a revision of Condition 1 to provide such a means. The <br />Division's letter was not intended to reopen negotiations on all <br />conditions to the approval of TR-08. <br />Considering the period of time the revision has been under review, <br />the correspondence exchanged and discussions had between BMRI and <br />the Divsion together with the rapidly approaching end of the 1993 <br />field season, the Division believes it is time to move ahead. The <br />Division is not inclined to accept your arguments that the issues <br />involved here require additional time to resolve or that this <br />revision, with its conditions, presents any unusual difficulty in <br />being integrated with the requirements of the new regulations. <br />Therefore, the Division is approving TR-08 with the following <br />conditions that include modifications which should deal with BMRI's <br />concerns: <br />1.
