Long
Division Director
Technical Revision 8
The Division has received your letter dated August 27, 1993 in
which you have indicated the conditions to the apgrova~l of TR-08
proposed by the Division are not entirely acceptable toy BMRI. The
Division is also committed to reaching an acceptable resolution to
the issues surrounding TR-OS but, unfortunately, does not share
your view that these conditions were not fully discus$ed and an
understanding reached between representatives of Battle Mountain
and the Division in the meeting on July 2, 1993. My notes indicate
Conditions 2 thru 4 were acceptable to BMRI's representatives at
that time. Nothing more than a revision of Condition 1 was
requested then by BMRI in order that there be some manner in which
the company could justify the termination of the monitoring network
before a minimum of 15 years of operation. As a result of that
understanding, the Division only proposed, in its letter of July
12, 1993, a revision of Condition 1 to provide such a means. The
Division's letter was not intended to reopen negotiations on all
conditions to the approval of TR-08.
Considering the period of time the revision has been under review,
the correspondence exchanged and discussions had between BMRI and
the Divsion together with the rapidly approaching end of the 1993
field season, the Division believes it is time to move ahead. The
Division is not inclined to accept your arguments that the issues
involved here require additional time to resolve or that this
revision, with its conditions, presents any unusual difficulty in
being integrated with the requirements of the new regulations.
Therefore, the Division is approving TR-08 with the following
conditions that include modifications which should deal with BMRI's
concerns:
1. Battle Mountain Resources will maintain and
