Letter to Kathryn F. Cloutier 2 August 11, 2005 <br />Adeguacv of the AM-Ol Application Permit No. M-1977-526 <br />considerable benefit to reclamation. Therefore, DMG recommends the following modifications to the seed <br />mix proposed in AM-Ol: <br />• Eliminate Crested and Intermediate Wheatgrasses finm the mix and replace with five pounds pure <br />live seed (P.L.S.) per acre Western Wheatgrass. <br />• Eliminate Winter Wheat from the seed mixture. <br />• Add Cicer Milk Vetch to the seed mixture at a rate of one-pound P.L.S. per acre. <br />3. Inspection <br />In accordance with Rule 3.2(7) DMG must inspect the Worthing Pit, including areas to be added through <br />AM-Ol, prior to making a decision on the AM-Ol application. Ben Frei will be contacted to set up a time <br />for the inspection, as he is listed as the inspection contact on page 3 of the AM-Ol application form. <br />4. Reclamation Costs <br />The DMG has reviewed the reclamation cost estimate provided in Exhibit L to the AM-Ol application and <br />concurs with earthmoving costs contained therein. Please find enclosed copies of the DMG's estimate of <br />the Worthing Pit revegetation costs, dewatering costs, and a reclamation cost summary form. In accordance <br />with DMG's re-estimation of these costs, the amount of bond required for the AM-Ol application is <br />currently $261,000.00. Please note that DMG's estimated cost for dewatering is significantly higher than <br />that provided in AM-O1 exhibit L. This maybe due to certain assumptions used to prepaze the DMG <br />dewatering estimate, which aze: <br />• That the entirety of the existing Worthing Pit lakes and the north expansion azea would be subject to <br />dewatering at the time of reclamation, for a total of 107 acres of surface water and 11,500 feet of <br />lake perimeter. <br />• That there is an average of 35 feet water depth over the 107 acres to be dewatered. This assumption <br />comes from the statement in technical revision TR-002 that pit depths in the existing Worthing pit <br />could be as much as 55 to 60 feet, and the statements in AM-Ol that pit depths in the north <br />expansion area will be very much shallower. <br />If you can provide better information for DMG to input to the dewatering estimate, the estimate can be <br />modified accordingly. DMG notes that no costs were applied to the Exhibit L estimate for demolition and <br />debris disposal for structures that have been or may be erected at the site to facilitate the operation of the <br />pit. DMG will evaluate site structures during the up-coming inspection, and depending on the outcome of <br />that evaluation, additional costs maybe applied to DMG's working estimate. <br />5. Public Comments and Date for Consideration of the Application <br />The DMG has received from you a copy of the notice sent to landowners within 200 feet of the affected <br />land in a mailing on July 21, 2005. That notice correctly establishes the final date public comments will be <br />accepted for this application as August 22, 2005. In accordance with Rule 1.6.6, DMG hereby establishes <br />the date for consideration of the application as September 1, 2005. This date will allow the DMG a period <br />of time to review any public comments that are received, formulate a recommendation on the AM-O1 <br />application, and schedule apre-hearing conference and a formal public hearing on the application if needed <br />(see Rules 1.4,9, 1.7, and 2.7). As we have previously discussed, one public comment letter has already <br />been received by DMG from adjacent landowner Grace Russell. You have notified DMG, in a telephone <br />conversation, that you received a copy of Ms. Russell's public comment letter in eazly July 2005. This <br />
