SPECIAL STIPULATIONS (8/2003) COC-65038 <br />1. Yearly production figures shall be reported during January of each year. <br />2. Offsite areas will be protected from accelerated erosion such as gullying, piping and mass wasting. <br />3. All heavy equipment, fuels and other potentially polluting products will be stored out of areas prone to <br />receiving flood runoff. <br />4. Permittee is responsible for all suppression costs for any fire resulting from their operations and <br />practices. <br />5. Permittee is responsible for disposing of all debris in accordance with state and federal regulations. <br />Permittee is responsible for keeping the material site free of all litter and trash. <br />6. If subsurface cultural resources are unearthed during operations, activity in the vicinity of the cultural <br />resource will cease and a BLM representative notified immediately. Pursuant to 43 CFR 10.4 the <br />holder of this authorization must notify the authorized officer, by telephone, with written confirmation, <br />immediately upon the discovery of human remains, funerary items, sacred objects, or objects of <br />cultural patrimony. Further, the operator must stop activities in the vicinity of the discovery and <br />protect it for 30 days or until notified to proceed by the authorized officer. <br />7. The operator is responsible for informing all persons associated with this project that they will be <br />subject to prosecution for knowingly disturbing Native American Indian shrines, historic and <br />prehistoric archaeology sites, or for collecting artifacts of any kind, including historic items and/or <br />arrowheads and pottery fragments from Federal lands. <br />8. The top 6-12 inches of topsoil shall be removed and stockpiled for later use in pit reclamation. The stockpile <br />shall be stacked in an area where it will not be disturbed until used for pit reclamation. This stockpiled material <br />shall be stabilized with the seed mix described below. <br />9. Between operations, the pit wall shall be maintained at a slope ratio not to exceed 2:1 so as to minimize slope <br />failure potential and public safety hazards. <br />10. Pit rehabilitation shall consist of, but not be limited to, the following requirements: <br />a. The Uncompahgre Field Office shall be contacted five (5) days prior to the commencement of <br />reclamation. <br />b. All rejected oversized material will be buried in the excavation prior to rehabilitation. <br />c. The pit walls shall be sloped to existing contours not to exceed 2:1 and compatible with the surrounding <br />landforms. <br />d. Once a disturbed area is recontoured so that the desired topography is generallyre~stablished, the entire <br />surface area (especially slopes) will be "pocked" to minimize the potential for future erosion andenhance <br />revegetation efforts. Depression storage "pocks" will be constructed on the reclaimed area to capture and <br />store on-site generated storm waters, soils, and seeds. Depression storage shall consist of shallow <br />(approximately 2' deep) pits, 8-10 feet in diameter. Excavated material will be deposited on the <br />downslope side of each depression.
