3. The weight of the evidence shows the Applicant has demonstrated <br />compliance with Construction Materials Rule 3.1.6(1)(a). <br />C. Description of Game and Non-Came Resources and the Impact <br />on those Resources <br />Construction Materials Rule 6.4.8(1) requires the applicant to provide a <br />description of the game and non-game resources on and in the vicinity of <br />the application. <br />2. The Applicant has consulted with the Colorado Division of Wildlife, <br />which has evaluated the potential impacts to wildlife from mining at the <br />site. The Colorado Division of Wildlife found that (1) wildlife species <br />that use the azea are limited because of the historic disturbance from past <br />dredge mining operations; (2) no endangered or threatened species will be <br />impacted by mining operations; (3) no critical habitat or vegetative <br />communities will be impacted; and (4) removal of the dredge piles will <br />hasten recovery of wildlife habitat. The Division further notes that no <br />deer or elk habitat exists within the affected area and that the cutthroat <br />trout population in the North Fork of the Swan River exists upstream from <br />the Mascot Placer. <br />3. The weight of the evidence shows the Applicant has demonstrated <br />compliance with Construction Materials Rule 6.4.8(1). <br />
