need to obtain a Special Use Permit to allow rock crushing at the site. The <br />Applicant is aware of this requirement. <br />The weight of the evidence shows that the Applicant has demonstrated <br />compliance with Construction Materials Rule 6.4.13. <br />B. Consideration oflmpacts to the Prevailing Hydrologic Balance <br />1. Construction Material Rule 3.1.6(1)(a) requires an applicant to minimize <br />disturbances to the prevailing hydrologic balance of the affected land and <br />surrounding area by complying with applicable Colorado water laws and <br />regulations governing injury to existing water rights. <br />The Applicant has agreed to use controlled mining methods to avoid <br />impacts to water of the United States when mining in proximity to such <br />waters. The material to be dredged is chemically inert, so contaminants <br />will not be liberated from the rock during mining operations with the <br />possible exception of silt. The Applicant will install runoff controls in the <br />form of perimeter berms, which will filter suspended fines from mining. <br />Fuel and lubricants stored on-site pose another possible source of <br />contamination that could impact the prevailing hydrologic balance. The <br />Applicant will store such fuels above the floodplain in berms lined with <br />protective membranes. Valves will be monitored at all times during <br />fueling, and all spills will be reported immediately to the Division. <br />Mobile fuel tankers may be used instead of stationary tanks. <br />
