The Division received numerous <br />comments during the public comment period, which closed on December 27, 2006. <br />Because objections were received during the comment periods, the matter was set for a <br />formal Boazd hearing pursuant to Construction Materials Rule ("Rule") 1.7.4(2). <br />4. The Boazd has jurisdiction over the parties and this matter pursuant to Sections 34-32.5- <br />104, 34-32.5-105, 107, 112(7) and 34-32.5-114 of the Colorado Land Reclamation Act <br />for the Extraction of Construction Materials, Section 34-32-5-101 et seg. C.R.S. (2006) <br />("Act"). <br />5. On January 24, 2007, a hearing officer appointed by the Board conducted a prehearing <br />conference in Granby, Colorado pursuant to Rules 2.6 and 2.7. As a result of the <br />prehearing conference, the prehearing conference officer prepared a proposed prehearing <br />conference order. in addition to the Applicant, parties who appeared or who presented <br />proxy statements at the prehearing conference included Jill and Bill Hansen, Bill and <br />Shazon Spurlin, Mark and Lisa Mirabito, and Scott and Christine Holley. All other <br />commenters did not appear and thus lost their party status pursuant to Rule 2.7.3(4). <br />6. At the formal Boazd hearing on February 14, 2007, the Board approved the proposed <br />prehearing conference order. The party objectors who appeared at the formal Boazd <br />hearing, and who thus maintained their party status, were Jill Hansen and Shazon Spurlin. <br />All other objectors who attended the prehearing conference lost their party status <br />pursuant to Rule 2.8.1(1). <br />The issues set forth in the prehearing order are: <br />A.
