2015" etc. A descriptive narrative in the Mining Plan would be appropriate. <br />f) if different from the original permit, provide a narrative describing the nature, depth and <br />thickness of the deposit to be mined and describe the nature of the stratum immeadiately <br />beneath the material to be mined. <br />g) identify the primary and secondazy commodities to be mined/extracted and describe the <br />intended use. <br />6. Rule 6.4.5 -Reclamation Plan - if there are no changes to the existing plan, no new <br />information is required. However, it should be noted that the DOW suggests "restoring the <br />site to native prairie condition and avoidance ofnon-native species in the re-vegetation <br />mix." The current approved seed mix contains Western Wheatgrass, Blue Grama, Arizona <br />Fescue and Prairie Sandreed. According to the 1985 Range Condition Inventory, Blue <br />Grama, Prairie Junegrass and Western Wheatgrass were the predominant species. Some <br />Prairie Sandreed, Three Awn, Sumsedge and Muttongrass comprised only 18% of the <br />native grass. It appeazs the only species (representing 20% of the native population <br />observed in 1985) not included in the approved seed mix is Prairie Junegrass. The <br />applicant may want to add this species to the seed mix since the DOW feels it will improve <br />the chances of returning this area to native grassland. The NRCS can provide information <br />on how much Prairie Junegrass seed would be required per acre to provide an appropriate <br />seed mix for the area. A narrative in the Reclamation Plan would be required if you agree <br />to follow the DOW recommendation. Also, you should contact the NRCS and-ask them to <br />determine how much Prairie Junegrass you should include in the mix (PLS/acre) and <br />provide that information to the DMG in your next response. <br />7. Rule 6.4.6 -Reclamation Plan Map - in addition to complying with Rule 6.2, the map(s) <br />must show the expected physical appearance of the area of the affected land with contour <br />lines of sufficient detail to portray the direction and rate of slope of all reclaimed lands. <br />The existing reclamation plan map does not show the proposed topography of the amended <br />area so a new map is required.-You did not address this issue in your latest response. Since <br />the permit azea is being expanded, the physical appearance will change. As a result, a new <br />map must be submitted. <br />8. Rule 6.4.19 -Permanent Man-Made Structures - a power line entering the existing site <br />(overhead along the south side of the access road, then underground to the equipment <br />parking azea) is considered aman-made structure so this Rule applies. In addition, the Rule <br />would apply if a power line is within 200 feet of the affected land area (on the east or south <br />side). Also, the on-site fuel tanks are not considered permanent man-made structures so <br />they do not have to be addressed in this Exhibit. The applicant must comply with <br />section "a" or "b" of this Rule. Paragraph "a" states that the Applicant must provide a <br />notazized agreement between the applicant and the person(s) having an interest in the <br />structure, that the applicant is to provide compensation for any damage to the structure. The <br />document you provided in your response does not meet the requirements of paragraph "a" <br />since it was not signed by the power company nor was your signature, or the power <br />company's signature, notarized. <br />Pursuant to Rule 1.8, the applicant must file a copy of this letter and a copy of the response with <br />the County Clerk and Recorder and provide the Division with an affidavit or receipt <br />demonstrating that the revision was filed with the Clerk and Recorder. <br />
