Plan Map). Also, as noted above, the map scale appears to be incorrect. Other items that still
need to be addressed are:
Rule 6.4.1 - Exhibit A -Legal Description -The application states that the proposed
expanded azea is located in Section 27-Township 9 South-Range 54 West. The Exhibit A
legal description shows the acreage in Section 27-Township 9 South-Range 64 West.
Which is correct? The application and Exhibit A must describe the same acreage location.
Make the appropriate changes and re-submit the revised document. Tt appeazs that the lands
aze located in Range 64 West not Range 54 West so page 2 of the application form needs to
be revised and re-submitted.
2. Rule 6.4.2 - Exhibit B -Index Map - An index map showing the regional location of
the affected land and all roads and other access to the azea. All the maps should show the
access road since it is part of the permit area. It is suppose to be a 30-foot wide road. Your
latest map has an arrow pointing to a "site location" in Section 26 not Section 27. Is the site
in Section 26 or Section 27? The index map should show. the approximate location of the
site, including the access road (draw it on the map as close as you can).
3. Rule 6.4.3 - Exhibit C - In addition to requirements of Rule 6.2 (see above), the Exhibit
C map(s) must legibly portray the following information:
a) all adjoining surface owners of record. Your map shows the adjoining landowners.
b) the name and location of all creeks, roads, buildings and power and communication
lines on the azea of affected land (along the access road and parking area) and within
two hundred feet of all boundazies of such area. Your map does not show a power line
on the east side of the proposed permit boundary. If a power line is located within 200
feet of the proposed expanded permit azea, it must be shown on the map.
c) the existing topography of the azea.with contour lines of sufficient detail to portray the
direction and rate of slope of the affected land (the original topographic map that was
submitted was identified as Exhibit F-a and did not conform to Rule 6.2). The
. latest topo map you submitted does not show the existing permit azea, or the proposed
expanded area. You need to revise the map to show the permit boundazies (which
should include the access road) because the outlined area on the latest topo map does
not reflect the existing permit or the proposed expanded permit area. In addition, the
topographic elevations are not the same. The elevation on the original map for the
pemut area was 6700 feet ams] and the elevation on the latest map is 5500 feet amsl.
Which is correct?
g) show the owner's name, type of structures, and location of all permanent or man-made
structures contained on the azea of affected land and within two hundred feet of the
affected land (this includes the weigh scales, which should have been located in the
east side of the approved permit azea, not along the access road). You have accurately
depicted the power line and the location of the scale house in the permit azea. However,
you may need to show the power line east of the permit area if it is within 200 feet of
the affected azea. Also, a fuel tank is not considered a permanent man-made structure.
Rule 6.4.4 -Mining Plan -the amendment application mentions "sections A, B, C and D".
Mining, appazently, will progress from section A, to section B, to section C, to section D.
This should be shown on the Mining Plan map(s). The latest map only shows sections A, B
and C. What happened to section D?
e) an approximate timetable to describe the mining operation should be provided. An
example would be "section A will be mined from 2002-2010, section B from 2010
