Ms. Erica Crosby <br />January 25, 2006 CARVER KIRCHHOFF SCI'iWARZ McNAB & BAILEY, LLC <br />Page 2 <br />Measures Taken fo Comply with Reclamation Requirements <br />Consistent your observations during your recent inspection of the site, RMCC has <br />completed sloping the existing area of mine disturbance, placed topsoil on the disturbed areas, <br />and completed reclamation seeding. The area where the materials processing equipment was <br />located (i.e., the crusher, screens, wash plant, stockpiles, etc.) has been left in its current <br />condition since such equipment will be relocated to the site in the near future when active <br />operations are recommenced. RMCC is presently working with the Office of the State Engineer <br />to update the substitute water supply plan for the site to address the expected evaporative loss <br />from the limited amount of open water exposed at the site. <br />Adeguacv of Existing Financial Warranhr <br />As a condition of the recently approved Transfer of Permit and Succession of Operator, <br />RMCC posted a replacement reclamation bond in the amount of $49,450, which was approved <br />as a condition of the transfer permit and succession of operator. Prior to recommencing <br />operations at Del Camino, RMCC will post a financial warranty in the amount of $278,182, which <br />equates to the $327,632 financial warranty the Division has requested less the existing financial <br />warranty of $49,450 that RMCC intends to maintain in place during the term of the temporary <br />cessation.
