As you requested, this letter renews the Notice initially filed on behalf of my client, Ready
Mixed Concrete Company ("RMCC"), on August 1, 2005. Based on your e-mail, I understand
that the Division is waiving the additional application fee. The following information is provided
in accordance with Construction Materials Rule 1.13.5(2).
Date of Cessation
Mining gperations ceased at the site temporarily on or about May 1, 2005. Reclamation
activities, as described below, had been ongoing and were completed prior to your November
8, 2005 site inspection.
Reason for Cessation
RMCC acquired the Del Camino operation from Owens Bros. Concrete Co. in an asset
purchase transaction that closed on or about September 28, 2004. RMCC subsequently sought
and obtained approval from the Division of its request for Transfer of Permit No. M-1996-052 and
Succession of Operator. RMCC is continuing to mine construction aggregate materials in
Adams County that are located proximate to various of RMCC's existing ready mixed concrete
production operations and other of RMCC's customers. RMCC intends to concentrate on these
operations before transitioning its mining operations to sites like Del Camino in Weld County.
Plan for Resumption of Minina
Within the next five (5) years, RMCC's business plan calls for the mining and reclamation
of construction aggregate resources located in Weld County. Relocating its operations to areas
and markets north of its existing operations is consistent with the orderly development of the
reserves RMCC acquired from Owens Bros. Concrete Co.
HUDSON'S BAY CENTRE ~ 1600 STOUT STREET, SUITE 1700 ° DENVER, COLORAD080202
MAIN 303.893.1815 ~ Fax 303.893.1829 ~ www.cksmb.com
