Permit M-1988-140 <br />Dear AI: <br />I received on March 23, 2002, a copy of your letter to Merrill Wright regarding the <br />required proof of publication of the public notice and proof of notice to adjacent <br />landowners regarding the subject permit amendment. <br />Enclosed is a copy of the page from the Fairplay FLUME containing the published public <br />notice. It should suffice, I believe, as proof of publication. This is the same page I sent by <br />fax to you earlier today. <br />t have not yet received from Mr. Eber, the only landowner adjacent to the amended <br />permit area, the Return Receipt from the certified letter I sent him on March 18"'. I made <br />several calls to him this past weekend, which he returned this morning. He has been out <br />of town for several days and has not yet received and read his mail. In his absence, the <br />certified letter may have been signed by another, or it may be delivered today for his <br />signature. In any event, it seems unlikely that I will receive the Return Receipt in time to <br />forward a copy to you by March 27"'. <br />However, I have enclosed copies of the letter and notice copy I sent Mr. Eber on March <br />18 and which I faxed you earlier. t am hopeful that these would be adequate proof of <br />notice to Mr. Eber so that the Division of Minerals and Geology could approve the <br />requested Amendment on March 27, 2002. <br />If the Department deades the documents furnished are not adequate proof, however, <br />and requires a copy of the Return Receipt, then please consider this letter as a request <br />for a postponement of the decision date for up to one month, if necessary, to allow time <br />for receipt of the required Return Receipt from Mr. Eber. After talking with you about the <br />details of requesting an extension, 1 spoke with Mertill Wright and he authorized me to <br />make tltis request in his behalf.
