Cattany <br />Division Director <br />Natural Resource Trustee <br />On May 3Q 2003 the Division of Minerals and Geology conditionally approved the permit amendment <br />application submitted to the Division on January 14, 2003, addressing the following: <br />Change in post mining land use from Open Forest to Rangeland for the majority of the affected <br />land. <br />Change in post mining land use from Open Forest to IndustriaUCommercial for 20 acres at the <br />mine site. <br />Deletion of the Lost Creek Reservoir area from the permit. <br />Change in the tree and shrub planting requirements for the tailing impoundment. <br />Incorporation of an alternative reclamation plan for the tailing impoundment using a wet cover <br />and a post mining land use of developed water resources. This alternative plan will not be <br />implemented unless and until an amendment to the reclamation permit is approved that provides <br />plans and details for wet cover reclamation. Until such an amendment is approved, the required <br />and bonded reclamation is the construction of a dry cover as described in the original permit <br />application and as modified in this amendment AM-04. <br />Stipulation No. 1 to the approval of amendment AM-04: <br />Prior to installation of the tree and shrub islands in the tailing impoundment as discussed in <br />amendment AM-04, a technical revision to the permit is required that will describe the location, <br />size, shape, and thickness of each proposed island. <br />The changes to components of the reclamation plan result in adjustments to the working reclamation cost <br />estimate that is the basis for the amount of the required fmancial warranty from $43,559,013.00 to <br />$41,119,644.00. The details of the cost estimating work completed for amendment AM-04 are included <br />as attachments to this letter. Henderson has submitted documents relating to water rights deeds of frost in <br />order to provide interim reclamation bond. These deeds of trust aze still under review. Also under review <br />is the Henderson letter and attachments dated September 19, 2002 indicating that fiuther reductions in the <br />Office of Office of Colorado <br />Mined Land Reclamation Active and Inactive Mines Geological Survel <br />
