The mine plan states that the mining excavation will have a setback of 100 feet <br /> from the boundary of the St. Vrain River. The revised map depicts the edge of <br /> excavation closer than 100 feet to the River. Technical Revision 002 (TR-002) <br /> approved by the Division on October 21, 1998, specifically addresses armoring the <br /> banks of the river, changing the seed mixture and planting desirable trees. The <br /> shoreline mitigation plan required by the Army Corps of Engineers was <br /> incorporated into the Bailey Pit reclamation plan for the previously mined area of <br /> Lake #1. Please clarify if the remaining mining area will maintain the 100 foot set <br /> back distance. If the operator intends to mine closer than 100 feet to the River on <br /> the remaining area, then a streambank mitigation plan will need to be incorporated <br /> into the permit. <br /> 5. The map as depicted under your review was in error. A revised map and copy is <br /> included with this submittal (refer to Item #1, above) showing the proper relation to <br /> existing and planned set backs. All shorelines shown less than 100 feet between <br /> Lakes and St. Vrain Creek are existing. The area of extraction remaining for Lake <br /> #1 now has a planned 100 foot setback, and extraction has yet to occur at this <br /> location. <br /> While the entire shoreline within the permit boundary is affected to some extent, <br /> and under reclamation in part under the authority of the U.S. Army Corps of <br /> Engineers, it is our understanding that the entire responsibility for reclaiming the <br /> shoreline up to 100 feet in width along either side of St. Vrain Creek, remains with <br /> Techtonics. <br /> 6. Doug Tiefel of Goose Haven Sand & Gravel, Inc. waived their right to a 30-day <br /> processing time for the Transfer of Permit and Succession of Operators (SO-003) <br /> received by the Division on March 23, 2000. The Division will approve SO-003 once <br /> the operator has addressed the above noted items and the reclamation bond has <br /> been calculated. <br /> 6.
