molybdenum mine, the Henderson Mine, winds down. The Operator expects the Climax <br />Mine to replace the Henderson Mine eventually as the long-term producer of molybdenum <br />for the chemical applications market. The Operator has provided proof to the Division that <br />there exists a lazge and viable molybdenite ore body at the Climax Mine. In the meantime, <br />the Operator intends to operate the Climax Mine as a swing producer, defined in the existing <br />permit as an operation maintained in a ready state with the ability to come on-line quickly in <br />response to market demand. Through the amendment application, the Operator seeks the <br />Board's approval to extend the life of the Climax Mine. <br />Section 34-32-116(7)(q) of the Mined Land Reclamation Act, Sections 34-32-101 et seq. <br />C.R.S. (2005) ("Act") states the general rule that, with certain exceptions not applicable <br />here, each phase of final reclamation "shall be completed prior to the expiration of five <br />years after the date on which the operator advises the boazd that such phase has commenced, <br />unless such period is extended by the board pursuant to Section 34-32-112(7) ...." <br />According to legal research conducted by the Division's attorney, this language was <br />intended to create an exemption from the temporary cessation requirement contained in <br />Section 34-32-103(6)(Ii). <br />4. The Division recommends that the Boazd accept atwenty-five (25) yeaz life of mine term <br />for the Climax Mine site, commencing on the signature date of the Board order for <br />Amendment AM-O5. The Division also recommends that the Board require informational <br />briefings from the Operator every five years, commencing in 2011. The briefing is to <br />include discussion of the mining and reclamation status of the Climax and Henderson mines, <br />and the molybdenum market. It is understood that regulatory actions affecting the <br />Henderson Mine must be accomplished through separate proceedings. <br />M-1977-493 <br />Climax Mine <br />
