~~, I~ ti P, clo a~~ sru e i b <br />RECEIVED <br />BEFORE THE MINED LAND RECLAMATION BOARD ~ ~ ~ 2006 <br />STATE OF COLORADO Division of Mineral; and 6aolc,y <br />FINDINGS OF FACT, CONCLUSIONS OF LAW AND ORDER <br />IN THE MATTER OF CLIMAX MOLYBDENUM COMPANY'S REQUEST FOR <br />PERMIT AMENDMENT, CLIMAX MINE, FILE NUMBER M-1977-493 ~ <br />THIS MATTER came before the Colorado Mined Land Reclamation Board <br />("Board") on January 11, 2006 in Denver, Colorado for a hearing to consider the request of <br />Climax Molybdenum Co., Inc. ("Operator") for an amendment, AM-O5, to an existing <br />reclamation permit which would increase the time required for completing reclamation. The <br />file number in this matter is M-1977-493. Bryce Romig and Brian Nazarenus, Esq., <br />appeared on behalf of the Operator. Allen Sorenson and Steve Brown, Esq., appeared on <br />behalf of the Colorado Division of Minerals and Geology ("Division"). <br />The Board, having considered the parties' presentations and having been otherwise fully <br />informed of the facts in this matter, hereby enters the following findings of fact, conclusions of <br />law and order: <br />In 1977, the Board approved the Operator's application for a Section 112d-3 reclamation <br />permit fora 14,000-acre site located in Section 12, Township 8 South, Range 79 West, 6~h <br />Principal Meridian, in Lake, Summit and Eagle Counties, Colorado. The Operator has <br />mined molybdenum from the site in the past but no production is occurring at the facility at <br />this time. Active reclamation is taking place at the site. The location is referred to as the <br />Climax Mine. <br />The Operator seeks an amendment to its current reclamation permit extending the life of the <br />Climax Mine to twenty-five (25) years. The Climax Mine is not being operated at this time <br />but the Operator expects it to begin production as production in another Operator-owned <br />M-1977-493 <br />Climax Mine <br />
