Rationale for Recommendation for Approval over Objections; <br />Regular 112 Construction Materials Amendment Application, <br />Holcim (US} Inc. <br />Coaldale Quarry, Permit No. M-1977-247 <br />June 8, 2007 <br />Introduction <br />On June 8, 2007 the Division of Reclamation, Mining, and Safety ("Division")issued its <br />recommendation for approval of a 112 Construction Materials Amendment Application, over <br />objections. This document is intended to provide a basis for the Division's recommended approval <br />over various concerns and objections to the Coaldale Quarry amendment application, Permit No. M- <br />1977-247. <br />The Holcim (US) Inc. amendment application was found complete and considered filed with the <br />Division on February 28, 2007. The site is located approximately two miles south of U.S. Highway 50 <br />in the unincorporated Town of Coaldale, Fremont County, Colorado. The center of the quarry is <br />located in Section 32, Township 48 North, Range 11 East, Sixth Principal Meridian. The permit area is <br />82 acres in size. The post-mining land use for the site is wildlife habitat. <br />I. OBJECTIONS: <br />The Division received numerous written comments on the amendment application during the public <br />comment period, which ended Apri123, 2007. <br />II. ISSUES RAISED BY OBJECTING PARTIES: <br />Issues raised by objecting parties are listed below. Due to the volume of the objections raised, only the <br />key arguments are quoted. The Division's response to objection issues follows. Issues that the Division <br />believes are not within the jurisdiction of the Division or the Mined Land Reclamation Board ("Boazd" <br />or "MLRB") are listed afterwazds. <br />A. ISSUES WITHIN THE JURISDICTION OF THE DIVISION AND BOARD <br />1. What about the health concerns of the citizens of Coaldale? <br />Division's Response <br />Health of the nearby community will be assured through compliance with the state and local <br />permits required. These include the mined land reclamation permit, as well as permits required the <br />Colorado Department of Public Health and Environment, Water Quality Control Division (storm <br />water permit), and the Air Pollution Control Division. A permit from Fremont County is also <br />required. <br />2. Quarry will negatively impact wildlife. <br />
