TITLE IV COMPLLANCE (Y/N}: N/A <br />COMMENTS/OTHER: Although the commensurate use, upkeep, and nmintenance of the NFSR228 road world normally be <br />covered wi~ihin a mining operator's npproved Plan ofOperatians (POO), the Forest Service has rejected the draft POO that Colorado <br />Marble has submitted to the Salida Rwrger District due to a discrepancy in the classifrcation of the minerals Colorado Marble is <br />procuring from NFS lands. Since Colorado Marblz does not have nn approved POO in place, but still requires the use ojNFSR228 in <br />ardor to both access private/patented mining cluints, as well as implement Colorado Deparhnent ofMinerals and Geology <br />reclamation stipulations, the Snlida Ranger District recommends That a FLPMA Special Use Raad Permit be issued to the proponent. <br />As the upkeep mrd maiutenmrce activities have beery taking place on the NFSR228 road since [he late 1980's, r:o new nutiraenarrce <br />activities will take place on die NFSR228 road other than tlrnse that are recommended by Forest Engineers or Permit Administrators. <br />.Additionally, dye Snlida Ranger District recommends that the propmrent provide the agency with a bond or Irrevocable Letter of <br />Credit to proted the agency against potential resoerce damages which might occur as a result of the road maintenance activities, or <br />in the event the proponent experiences m foreseen financial diJ~culties is the future. <br />r <br />Signature Date <br />
