BMR would <br />suggest that the terms of the retention of WWL, the frequency and total number of <br />verification samples and the duration of their activities be set forth in an agreement to be <br />negotiated between BMR, WWL and your office. The analytical laboratory to be utilized <br />should be selected with input from the contractor. BMR representatives wall be prepared <br />to finalize this concept with you at your earliest convenience. <br />BMR believes that the enclosed information is fully responsive to the requirements <br />of Abatement Requirement No. 12 and looks forward to resolving any outgtanding issues <br />and obtaining approval of the technical revision from your office as soon us possible. In <br />addition, we note that BMR will be proceeding with work aimed at resolving questions <br />regarding the chemical homogeneity of the tailings ponds and anomalies in analytical <br />laboratory results in general accord with the discussion held between Dr. Shutt (BEI) and <br />Harry Posey of your office on April 22. In the event this work results in proposed <br />modifications to the enclosed protocol, they will be submitted expeditiously flor your review <br />and approval.
