This technical revision is submitted in compliance with Abatement <br />Requirement No. 12 which was imposed in conjunction with the recent enforcement action <br />taken by your office at the San Luis facility. BMR believes that the enclosed protocol meets <br />all of the requirements set forth in Abatement Requirement No. 12 end intends to <br />commence the procedures set forth in the document upon receipt of appr4va] from your <br />office. <br />Abatement Requirement No. 12 requires BMR to propose an arrangelment by which <br />sample collection and analytical activities at the site are verified by a third party entity at <br />BMR's expense. BMR's standard practice is to conduct the required moniltoring through <br />a combination of in house technicians and outside contractors. BMR anticipates continuing <br />its practice of utilizing Halepaska and Associates for outside sampling assistance as <br />necessary and Acculabs Inc. for outside analytical work. In response to the requirement for <br />third party verification, BMR would propose that Water Waste and Land, Inc. ("WWL") be <br />retained at BMR's expense to conduct periodic sampling and analytical Work using the <br />
