Box 548 <br />Telluride, Colorado 81435 <br />Re: Application for the Proposed Development in a Wetlands Area, Pathfinder Pit <br />access road rebuild, Lake Fork of the San Miguel River near Ophir, Colorado. <br />~ Z~z Re-~~Q- <br />Pursuant to the terms of the previous 1999 Army Corps Nationwide Permit, (and <br />any such supplemental permitting) for this re-alignment; Orders of the, San Miguel <br />County District Court re: case # Oi CV 113; The settlement agreement (SA) re: the <br />aforementioned case; and the stated intentions of Pathfinder Development Inc. re: <br />this realignment and drainage control project, Pathfinder hereby submits this <br />application supporting the construction necessary to effect the stated goals of this <br />project. <br />As you may recall, this section of the Pathfinder Access Road was the site of a <br />series of unfortunate erosive events caused by repeated failures of the PSCo (Xcel <br />Energy) pipeline running underneath this roadway. You may also review the earlier <br />(1999) permit application submitted by Xcel to the County in support of a very <br />similar solution to this continuing situation. Without rehashing these years of <br />subsequent events re: Pathfinder, Xcel, the County, the Courts, or other third parties; <br />
