This permit authorized impacts to 0.12 acre of wetlands associated with the construction of a haul road to protect the Ames Hydro Penstock located near Ophir. The approval included a requirement for onsite compensatory wetland mitigation which your plan addresses. The mitigation proposal submitted is acceptable. This includes your commitment to provide annual monitoring reports with photographs by October 1 for the next three years. we do ask that you include a fifth photo point that includes a northwest view of the roadway drainage ditch. Additionally, only native wetland species shall be used in the mitigation area (preferably onsite materials). If a problem with the mitigation is encountered, contingencies shall be identified for our review and approval prior to implementation. As you know, San Miguel County has enacted wetland and waterway control regulations which are more restrictive than the Section 404 Clean Water Act regulations. We understand that you are currently working with the County for necessary permits at this site. The Department of the Army permit (404 permit) requires you to comply with all local, county, and state laws and regulations. Please reference permit number 199975336 in your monitoring report submittals or any other correspondence with this office concerning this site.
