This permit authorized impacts to 0.12 acre of <br />wetlands associated with the construction of a haul road to <br />protect the Ames Hydro Penstock located near Ophir. The approval <br />included a requirement for onsite compensatory wetland mitigation <br />which your plan addresses. <br />The mitigation proposal submitted is acceptable. This <br />includes your commitment to provide annual monitoring reports <br />with photographs by October 1 for the next three years. we do <br />ask that you include a fifth photo point that includes a <br />northwest view of the roadway drainage ditch. Additionally, only <br />native wetland species shall be used in the mitigation area <br />(preferably onsite materials). If a problem with the mitigation <br />is encountered, contingencies shall be identified for our review <br />and approval prior to implementation. <br />As you know, San Miguel County has enacted wetland and <br />waterway control regulations which are more restrictive than the <br />Section 404 Clean Water Act regulations. We understand that you <br />are currently working with the County for necessary permits at <br />this site. The Department of the Army permit (404 permit) <br />requires you to comply with all local, county, and state laws and <br />regulations. <br />Please reference permit number 199975336 in your monitoring <br />report submittals or any other correspondence with this office <br />concerning this site.
