RE: Reclamation Permit M-1977-300, the Cotter Corporation Schwartzwalder Mine

Dear Mr. Waldron:
The Cotter Corporation (Cotter) Schwarizwalder Mine (Mine) is located in Jefferson County.
The Mine has a 112R Hard Rock/ Metal reclamation permit with a total permitted affected area
of 51.89 acres in Section 25, T2S, R71W, 6PM and Section 8, T3S, R70W, 6PM. A total of
$343,928.00 in site reclamation costs for the Mine are currently covered under bond
This financial warranty amount was calculated in 1977 and revised in 1983,
1993, 1996 and 2002 in accordance with the work specified in the reclamation plan.
The Mine does not have a phased reclamation plan, but Cotter has been reclaiming surface
facilities and areas that are no longer used in the mining operation, in accordance with the
permit reclamation plan, since May of 1998. Cotter is requesting a review by the Division of
Minerals and Geology (Division) of reclamation work completed since the last warranty review
in 2002 and a reduction in the financial warranty to reflect the work completed under the
current reclamation plan for Permit M-1977-300.
An itemized list of reclamation work completed since 02/16/02 in accordance with the
approved reclamation plan and the reduction in direct reclamation costs for the work
completed is contained in Table A °Reclamation Work Completed for Permit M-1977-300."
Table A is followed by a recalculation of the required financial warranty to reflect reclamation
work that has been completed for permit M-1977-300 since the last warranty recalculation in
2002. The reclamation work and costs listed in Table A were taken from the thorough joint
warranty review conducted by the Division and Cotter from 1993 through 1996. The
recalculation of the warranty was also performed in accordance with the methodology used
by the Division in the joint warranty review conducted by the Division and Cotter in 1993
through 1996.
