Rule 6.4.5 Exhibit E- Reclamation Plan <br />5. The Division received comments regarding this amendment from various agencies. <br />These comment letters are being provided to the operator now and are enclosed with <br />this adequacy letter. Please address these comment letters as necessary. <br />6. The Division has noted less favorable reclamation success on slopes steeper than <br />3h:ly. Please commit to grading and reclaiming slopes at this site to 3h;ly or less steep <br />to increase the likelihood of reclamation success. <br />7. Please further describe the dimensions of the topsoil pile(s) that will be stored on site <br />and state the anticipated amount of cubic yards of topsoil that will be stored on-site at <br />all times. <br />8. Please provide additional information regarding revegetation techniques that will be <br />implemented on site - i.e. mulching (application method and rate/acre) and fertilizer <br />(application method and rate/acre). <br />Rule 6.4.12 Exhibit L -Reclamation Costs <br />9. Please provide an updated estimate for reclamation costs. <br />Rule 6.4.13 Exhibit M- Other Permits and Licenses <br />10. Please inform the Division if the following permits are necessary: Air Pollutant <br />Emission Notice (APED and Storm Water Management Permit (SWMP) through <br />Colorado Department of Public Health and the Environment (CDPHE). If these permits <br />are necessary, please revise Exhibit M. <br />Rule 6.4.19 Exhibit S- Permanent Man-made Structures <br />11. Where the mining activities will adversely affect the stability of any significant, <br />valuable and permanent man-made structure located within two hundred (200) feet of <br />the affected land, including gas, water, power lines, fences, roads, wells, ditches, and <br />any below-ground utilities, the Applicant shall either: <br />a) Provide a notarized agreement between the Applicant and the Person(s) having <br />an interest in the structure, that the Applicant is to provide compensation for <br />any damage to the structure; or <br />b) Where such an agreement cannot be reached, the Applicant shall provide an <br />appropriate engineering evaluation that demonstrates that such structure shall <br />not be damaged by activities occumng at the mining operation; or <br />c) Where such structure is a utility, the applicant may supply a notarized letter, on <br />utility letterhead, from the owner(s) of the utility that the mining and <br />2 <br />
