RotJueSt toa Rodu4l,an In A!'ectnd Acreage
The original permit appticat,on clearly cAntemplated the possibility that this tract might not
return to agncu4ural use ~ExMbrt E. p. E-50) Because of rts flat rymg terrain, ds paved areas,
warehouses and existing stom! water control system the remaining 9G acres in ISP Areas 2A
and 28 have become a highly desvable industrial staging area for cunent od and gas exploration
adiv, ties. The area was approved for Industrial use by zoning ordinance in the Town o1
Parachute. This iJing seeks td clariPj that the post-mining land use of this property wdl be the
industrial use similar to its present land use. and have rt removed from the affected acreage
invartory and from the MLRE3 permitted area.
in addmon to the above described Areas 2A and 28 wlth~n the Parachute Terminal area
proper, pWns were developed in 1981 and the perm, amentled to include another laydown area
to the east of the [ermmal site. This other laydown area became known as Mahaffey laydown
Area, and d is shown as Parachute Terminal Sate Area 2D on Exhibit F-t. The unusual 'U-
shaped - distwbance that appears as Area 2D on that exnibd is simply the outline or a series o!
earthen berms that were planned for constructor as the 5rst step in developing the area. These
berms were to channel runoff into a sediment pond that was to be bwtl on the sde at the
hydraulically lowest point. The construction of this laydown area was hatted In May 1982. and by
that time the actual construction disturbance on these 30 acres was limited to supping the
vegetation and topsoil in the narrow perimeter area to be occupietl oy the above described
berms Because of the IlmRed nature of the Csturbance. this area was reclaimed in 1982 to
permanent standards per the approved reclamation plan by replacing the recently stepped topsoil
and teen seeding w,ln the permanent seed mix for the Parachute areas It has since been
returned to agncWtural use (graz~ngj. This area has already been returned to GIs pre-mimng
agricultural land use and Is cons, dered reclaimed m accordance with Ilia approved reclamation
plan.
