• Exceedance verification measures - if an exceedance is observed, a 2nd sample <br />should be taken & if the exceedance still exists, a 3'd sample should be taken. If the <br />3rd sample is au exceedance then a more extensive sampling program & <br />investigation will be employed to determine the magnitude & extent of exceedance. <br />• Notification procedures to be followed in the event of an exceedance will need to be <br />consistent w/ the requirements of Rule 3.1.13. <br />• In the event that mitigation measures are required, the operator will need to submit <br />an immediate response and short term mitigation plan within 3 working days <br />following the completion of the immediate response measures. <br />• Need to verify, via certified mail return receipts, that the Landrus's have received a <br />copy of the operator's proposed water quality monitoring plan. <br />• The water quality plan presented is for a period of two (2) years. The operator will <br />need to submit a revised plan for on-going monitoring no later than 60 days prior to <br />the end of the initial 2 year monitoring. The revised plan will require Division <br />review and approval via the technical revision process. <br />• Need to include phosphate or other suitable measure of phosphorus as an analyte in <br />baseline sampling. <br />Once again, we will look forward to two (2) copies of your response on or before November 15, <br />2005. <br />Sincerely, <br />Thomas A.
