96 61 05 le~4l S E6S 585 9947 8RA DENVE:
BATTLE MOUNTAIN RESOURCES, SAN LUIS PROJECT
CMLRD ADEQUACY LETTER RESPONSES
EXHIBIT G, PATER RESOURCES
47. The water balance identifies the three (3) sources of water to be
obtained from: (1J affsite, (2J recycled tallings slurry, and (3J
pft dewatering. The offsite supply is dependent upon a water court
decision on change of use yet to be finalized. A plan-for-
augmentation is also a part of this ruling. A second Court case is
pending to adjudicate nontributary water. At this time, please
discuss the following for clarffication purposes;
a. As the tailings disposal area is to be lined and designed to
recycle incident precipitation from a 2D5 acre area, is this
amount of water considered in the plan-for-augmentation or
temporary substitute supply plan?
b. How is the amount of moisture retained in the tallings
considered from a water rights perspective?
RESPONSE: Battle Mountain's proposed plan for augmentation contemplates the
consumptive use of 1,647 acre-ft/yr of water. Battle Mountain's
proposed temporary substitute supply plan contemplates the
consumptive use of 500 acre-ft of water during 1990 fora period of
one year during the initial start up phase. In these water rights
filings, Battle Mountain has assumed that incident precipitation on
the tailings area and moisture retained in the tailings will
constitute consumptive use of water and has allocated a sufficient
quantity of water to cover both potential uses.
EXHIBIT L, RECLANATION COSTS
48. Based upon Exhibit D and Figures C-11 and C-13, 1t would appear that
a point of maximum disturbance within the tailings disposal facility
is reached near the end of the life of the facility. At that point
in time, the configuration of the tails 1s such that a slope toward
the center of the facility has been created, Please include an
estimated cost to grade the entire facility to achieve a .!.5X grade
toward a central, armored ditch, which would convey water off the
facility surface to the spillway.
RESPONSE: Revised Exhibit L contains a cost for construction of the small law
flow channels over the tailings Impoundment as per MLRD discussion
and the responses to comments 41 and 42.
11
