r <br /> Maintenance <br /> Western Mobile will cause negative conditions disclosed during semi-annual inspections to <br /> be corrected. For example, measures will be taken to remove burrowing animals; to provide for <br /> the removal of unwanted plant growth (such as trees and shrubs); and to repair areas of erosion, <br /> settlement, displacement of erosion protection, and subsidence, if any. Areas of erosion, <br /> settlement, displacement of erosion protection, and subsidence will be immediately repaired, <br /> regraded, and reseeded, as needed. <br /> The Addition of Fill <br /> All fill placed on the berm to correct erosive conditions disclosed during a semi-annual <br /> inspection shall be 100 percent finer than 6 inches and shall be placed in 8-inch maximum loose <br /> lifts and moisture conditioned to 2 percent below to 2 percent above optimum moisture content. <br /> All such material shall be compacted to at least 95 percent standard Proctor maximum dry density <br /> (ASTM D 698). <br /> Owner Maintenance <br /> The Owner of the property (the University of Colorado) is ultimately responsible for <br /> maintenance of the berm and may require more rigorous or extensive maintenance. It is Western <br /> Mobile's intent to perform the inspections and maintenance described herein but not to interfere <br /> with the Owner's own inspection and maintenance activities. <br /> Conclusion <br /> Western Mobile will reclaim the berm in a timely manner and seek release of the <br /> reclamation bond amount covering the berm as soon as DMG determines adequate ground cover <br /> has been established. Upon release of this portion of the Deepe Farm Pit reclamation bond, the <br /> landowner, the University of Colorado, will assume inspection and maintenance obligations for the <br /> structure. <br />
