Hours of operation shall be from 7:00 a.m. to 7:00 <br />p.m., at maximum, Monday through Saturday; nevertheless, nighttime extraction or <br />processing, requiring lights, will not be allowed without the prior written approval of the <br />Lessor. No operations will be allowed in Area D on the dates on which there are Eagle <br />County Fair & Rodeo events, normally about ten days per year. <br />(C) Lessee shall complete reclamation up to reseeding Area D by not later than <br />December 31, 2006. <br />(D) The mining will begin by stripping the topsoil and overburden from an azea <br />immediately adjacent to the Area B boundary. The topsoiUoverburden stockpiles will be <br />located at the top of the slope on the northern edge of Area D. Lessee will extract and <br />crush the gravel from an open face as the product is needed. Earth moving equipment, <br />crusher/conveyor equipment and haul trucks will be used to extract, process, and load the <br />material from Area D. Material stockpiles will be located in Area D once there is <br />sufficient room. Water trucks will be available for dust control as needed. Transportation <br />of material excavated in Area D for processing and stockpiling in Area B will be through <br />the points of contiguity of Areas B and D and will not be allowed on Fairgrounds Road. <br />The existing access point at the north end of Area B along the paved Fairgrounds Road <br />will remain the sole access to the leasehold, for employees, visitors and exporting <br />materials, unless approved in writing by Lessor. <br />(E) Area D will be reclaimed as an agricultural azea consistent with the current <br />status of the land and in accordance with the Special Use Permit for Area D, including the <br />Landscape/ReclamationPian and Improvement Drawings included therein and attached <br />hereto as Exhibit 2 and portions of the applicafion for the Special Use Permit for Area D <br />attached hereto as Exhibit 3, consisting of recontouring all slopes, top soil placement, <br />reseeding with agricultural grasses as specified in Exhibit 2 and 3, and irrigation to <br />establish the vegetation. The side slopes will be regraded at a 3:1 slope, the floor of the <br />excavation will have approximately a 2% slope towazds the river with 4" - 8" of topsoil <br />added. As shown on the plans, the reclaimed side slopes will be undulating in most azeas <br />rather than uniform, to conform with the planning line developed for the Fairgrounds <br />Master Plan. Reclamation is deemed complete when site preparation is completed and the <br />revegetation plants are fully established for a period of one yeaz. Lessee will reprepaze <br />with topsoil or appropriate nutrients, reseed, and irrigate plants to the extent required to <br />establish growth consistent with the current vegetation (before mining) at any time during <br />the two yeazs following the expiration or eazlier termination of this Lease.
