Cottony <br />Division Director <br />Greg Lewicki and Associates Natural Resource Trustee <br />11541 Warrington Court <br />Parker, Colorad j 0138 / ~ / <br />Re: Anderso/n Pit, M-2005-021, Amendment AM-02, Preliminary A/deguacy Review (PAR). <br />Dear Mr.Wenzel, <br />The Division of Reclamation Mining and Safety has begun the review process for the above referenced <br />amendment. Please fine enclosed a copy of the Pre-operation Inspection which was conducted on the <br />site on May 3151, 2007. The inspection identified one issue that will need to be addressed with the other <br />issues noted below. Please clarify or correct the following issues: <br />1) The Division will need proof of publication and notice to landowners as soon as they are <br />available. In the interim, please provide the last date of publication so that the last day for <br />comments can be established. <br />2) Please find attached comments from the OSE. There appears to be outstanding issues which <br />need to be addressed. Please respond directly to the OSE and cc the Division a copy of that <br />response. <br />3) Please find enclosed comments from the Colorado Historical Society. It appears there are no <br />issues to note from them at this time. <br />4) The Pre-operational Inspection notes an underground fuel storage tank (UST) within the <br />proposed amendment area. Please provide documentation of the Phase 1 and Phase 2 <br />Environmental Assessment for the site and decommissioning plans. <br />5) Please provide a new Map C-1 that denotes the UST within the proposed permit area. <br />6) Under the Mining Plan (D-4) it is noted that when discharge water meets a certain threshold of <br />1000gpm, rip rap or boulders will be installed. Please clarify how the water volume will be <br />monitored to establish when the threshold will be reached. <br />7) It is noted that an asphalt plant will be on site from time to time. Please submit a plan for regular <br />clean up of overspill /reject of asphalt and its final disposition. <br />8) Please clarify how topsoil and overburden stockpiles will be protected from erosion. <br />9) Under the Reclamation Plan the worst case scenario implies only one highwall. Staff feels the <br />worst case would be mining to near the limits on all edges but not having reached them there <br />would be 1.5 to 1 highwalls. Please clarify. <br />10) Please clarify the acreage for the plant area and is this area included in the final case scenario for <br />reclamation? <br />Office of Office of <br />Mined Land Reclamation Active and Inactive Mines <br />
